Introduction and Governing Law
These are the Terms and Conditions of Sale applicable to purchases from OzHerbs. The use of this site is governed by the policies, terms and conditions set forth below. Please read them carefully. Your use of this site indicates your acceptance of these terms and conditions.
These terms and the State and Federal laws of Victoria, Australia and The Commonwealth of Australia apply to all transactions for the purchase of products from OzHerbs, its web site at ozherbs.com.au and any associated web pay (the "Site"). These terms represent the compete Agreement between OzHerbs and the Buyer covering the sale of Products from this Site.
Except for terms implied by applicable legislation, OzHerbs does not offer to any conditions, warranties, guarantees or representations relating to the quality, description or performance characteristics of the Products other than those set out in these terms.
The Buyer's completion of the order form on this Site will constitute an offer to the Buyer to purchase Products (the "Order"). All Orders are subject to acceptance by OzHerbs. Your receipt of an electronic or other form of Order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. OzHerbs reserves the right at any time after receipt of your order to accept or decline your order for any reason.
OzHerbs is not liable for any losses or damages caused by this website or any website linked to or from this website.
The prices displayed on this site are quoted in Australian (AUD) dollars and are valid and effective only in Australia. Prices do not include shipping or sales taxes, if applicable, which will be added to the total order price at checkout.
The prices to be paid by the Buyer for all Products will be OzHerbs current selling price on the date of receipt by OzHerbs of the Order, less any applicable discounts in effect at that time. All Orders will attract a delivery charge as set out on the Shipping information page.
OzHerbs will not be responsible for errors in pricing that appear on the Site. OzHerbs will notify a Buyer in the event of a pricing error on the Site before an Order is delivered and the Buyer will have the opportunity to cancel its Order within a reasonable time. OzHerbs reserves the right to cancel unilaterally any Order based on a mistake in pricing within a reasonable time of receiving that Order.
OzHerbs reserves the right to change its prices from time to time without prior notice to the Buyer. All prices displayed on this website include Australian Goods and Services Tax (GST).
"List price" is an estimate of the standard full price of the product, based on a standard industry mark-up. Products may never have actually been sold by OzHerbs at the "list price".
If a Product is out of stock when OzHerbs processes an Order, OzHerbs will contact the Buyer to discuss revised delivery times or refund options. A refund option does not apply if a product is subsequently out of stock when requested by the customer as part of the product exchange.
All Orders by the Buyer under this Agreement must be placed via forms provided on this Site and must specify the information requested, including (but without limitation):
(a) Quantity and description of Products
(b) The full street address to which the Product is to be delivered
(c) Current billing address to which credit card statements are sent
The Buyer must complete all information requested on the Order form before the Order is processed by OzHerbs. OzHerbs will send the Buyer an e-mail acknowledging the Products ordered as soon as possible after the Buyer places an Order. If OzHerbs does not accept the Buyer's Order for any reason, it will inform the Buyer by email in the same manner.
Delivery times quoted in the Site are indicative only. OzHerbs will endeavour to deliver your order within the specified time. The Buyer acknowledges that OzHerbs may, from time to time, be subject to production, delivery or other unforeseen delays and that OzHerbs may allocate distribution of Products ordered of Products ordered among its customers at its sole discretion.
If Buyer's Order has not been delivered within the stated time, the Buyer should contract Ozherbs at: firstname.lastname@example.org
If no-one is available at the delivery address to receive the Products, OzHerbs delivery agent will leave an "unable to deliver" card at the address and the Buyer should follow the directions on that card to obtain delivery of the Products. OzHerbs reserves the right to make partial delivery of an Order where multiple products have been ordered.
Credit card payment for Products purchased from Ozherbs via the Site can be made by PayPal.
Nothing contained on ozherbs.com.au is intended to be or should be taken as medical advice, diagnosis or treatment. All information is not a substitute for medical advice and is for the purposes of general knowledge only. Always seek the advice of your General Practitioner, other medical practitioner or qualified health provider when starting any health or nutritional related treatment, continuing with medical treatment or with any questions regarding yours or any other party's medical condition.
Product Return and Exchanges
OzHerbs will offer exchange of a product if returned by the Buyer and has not been opened or tampered with within 7 days of receiving it. Any faulty or damaged stock received will be replaced at no charge if OzHerbs is notified within 7 days of receiving the product. If an order has been received and it is incorrect through the fault of OzHerbs, it will be replaced at no additional charge to the customer or a full refund of the incorrect item(s) will be given upon its return to the OzHerbs warehouse. Products ordered incorrectly by the customer can be exchanged or a credit note can be arranged upon its arrival at the OzHerbs warehouse and inspected by OzHerbs staff confirm the product was returned within the 7 days and has not been opened or tampered with. Please note that the customer is responsible for the postage cost of items being returned. Product exchanges are limited to available stock on hand and OzHerbs will not be liable where a product a customer wishes to exchange their item for is no longer in stock. OzHerbs will not provide refunds for product returns other than in circumstances where required by Australian State and Federal Law.
Cancelling an Order
Once an order has been received, Ozherbs' normal exchange policy will apply should a customer wish to cancel or amend the other.
OzHerbs will arrange delivery of all Products to the Customer using a delivery method/carrier as selected by OzHerbs. A Buyer (must not arrange its own courier to collect the Products from OzHerbs unless agreed in writing.
When positing internationally, should the actual postage cost be greater than OzHerbs standard international postage cost ($39.95), OzHerbs reserves the right to contact the customers to request additional payment for the greater amount for the order to be posted.
Products Damaged in Transit
Claims for alleged damage to Products caused in transit from OzHerbs to the destination specified by the Buyer must be notified to OzHerbs within 24 hours of receipt of delivery and consignment note must be marked as "Received Damaged".
The Buyer must contact OzHerbs by e-mail to email@example.com and obtain return instructions. The Buyer must also supply a copy of the consignment note to OzHerbs. OzHerbs will contact the Buyer to arrange a suitable remedy.
By ordering from OzHerbs you grant us the right to add your contract details to our database. From time to time we may contact you about offers and new products. You can easily be removed by either unsubscribing via a link in our marketing e-mails, or contacting our Customer Service at firstname.lastname@example.org and we will remove you from marketing communications.
Amendment of Terms and Conditions
OzHerbs may revise these terms and conditions from time to time. Buyers should therefore periodically visit this page to familiarise themselves with any such revisions.
